Extranjero Hermano: Algunos defectos de la nueva Ley de Extranjería

Resumen La Ley de Extranjería de 2003 ha aumentado las atribuciones y potestades de la administración pública española y las obligaciones de los extranjeros. Colisiona con principios fundamentales de nuestro ordenamiento jurídico-constitucional. Frente a esa línea legislativa, proponemos una reforma sustancial por la que:

1. deje de ser infracción el encontrarse un extranjero en España sin autorización oficial;
2. se haga permanente un proceso de regularización por prescripción adquisitiva de la condición de residente; y
3. se incorporen los valores jurídicos de la hermandad humana, los vínculos históricos, la misericordia, la hospitalidad, la libertad, la amistad y el amor así como los principios de una globalización con rostro humano, gratitud, arraigabilidad e interés nacional.

Brother Foreigner: Some Deficiencies of the new Spanish Immigration Law by Lorenzo Peña
Summary
The 2003 Spanish Immigration Law runs afoul of fundamental legal values and principles recognized in the Spanish Constitution. It has enlarged the powers of the Administration and the duties of foreigners. As against such a legislative line, I propose a substantial reform by which:

1. the mere fact for a foreigner to be found in Spain without an official permit will not be considered an infringement of the law;
2. a permanent process of normalization will be established, by which foreigners will acquire legal residence after a certain time; and
3. the law will enforce the following values: human brotherhood, historic links, pity, hospitality, freedom, friendship and love, as well as the legal principles of a globalization with a human face, gratefulness, integrability and national interest.
